I. General Information

In this section of the Privacy Policy you will find information on the scope, data controller, data protection officer and data security. In addition, we explain in advance the meaning of important terms used in the data protection declaration.


1. Important terms

Browser: Computer program for displaying websites (e.g. Chrome, Firefox, Safari)

Cookies: Text files placed on the user’s computer by the web server accessed using the browser used. The stored cookie information can contain both an identifier (cookie ID), which serves for recognition, as well as content information such as registration status or information about visited websites. The browser sends the cookie information back to the web server with each request on subsequent, new visits to this page. Most browsers automatically accept cookies. You can manage cookies using the browser functions (usually under “Options” or “Settings”). This may disable cookie storage, make it dependent on your consent on a case-by-case basis, or otherwise restrict it. You can also delete cookies at any time.

Third countries: Countries outside the European Union (EU) or the European Economic Area (EEA).

Personal data: Any information relating to an identified or identifiable natural person. An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an on-line identifier or one or more specific characteristics which express the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

Pixel: Pixels are also called tracking pixels, web beacons or web bugs. These are small, invisible graphics in HTML e-mails or on web pages. When a document is opened, this small image is loaded from a server on the Internet, where the download is registered. In this way, the server operator can see if and when an e-mail was opened or a website visited. Usually this function is realized by calling a small program (Javascript). In this way, certain types of information can be recognized and passed on on your computer system, such as the content of cookies, the time and date of the page call and a description of the page on which the pixel-code is located.   

Profiling: Any automated processing of personal data consisting of the use of such personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to the work performance, economic situation, health, personal preferences, interests, reliability, conduct, whereabouts or movement of that natural person.

Services: Our offers, to which this data protection declaration applies (see scope of application).

Tracking: The collection of data and its evaluation regarding the behaviour of visitors to our services.

Tracking Technologies: Tracking can be done both through the activity logs (log files) stored on our web servers and by collecting data from your terminal device via pixels, cookies and similar tracking technologies.

Processing: any operation or set of operations which is carried out with or without the aid of automated means relating to personal data, such as collection, recording, organisation, sorting, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or association, qualification, erasure or destruction.


2. Scope

This privacy policy applies to the following offers:

  • Our online service, i.e. our webshop, available at https://nemcall.com and our blog, available at https:/nemcall.com/blog
  • Our telephone services, i.e. the hotlines “advice and ordering”, “customer service and support” and “business customers
  • Our business premises where encrypted video surveillance takes place, i.e. our offices and logistics centre
  • Our contractual cooperation with manufacturers/suppliers and contact persons of manufacturers/suppliers
  • Our job offers including the possibility to apply electronically to us
  • Whenever reference is otherwise made to this data protection declaration from one of our offers (e.g. websites, subdomains, mobile applications, web services or links to third party sites), regardless of how you access or use it.

All of these services are collectively referred to as “Services”.

II. Data processing in detail

In this section of the Privacy Policy, we will inform you in detail about the processing of personal data within the scope of our services. For the sake of clarity, we structure this information according to certain functionalities of our services. During the normal use of the services, different functionalities and thus different processing operations can take place one after the other or simultaneously.

1. General information about data processing

Unless otherwise indicated, all processing operations set out below are subject to this Regulation:

a. No obligation to provide & consequences of non-delivery

The provision of personal data is not required by law or contract and you are not required to provide data. In the course of the input process, we will inform you if the provision of personal data is necessary for the respective service (e.g. by designating it as a “mandatory field”). If data is required, the non-availability of this data means that the service in question cannot be provided. Otherwise, the non-availability may result in us not being able to provide our services in the same form and quality.

b. Consent

In various cases you have the opportunity to give us your consent to further processing in connection with the processing operations described below (possibly for some of the data). In this case, we will inform you separately about the modalities and scope of the consent and about the purposes that we pursue with these processing operations in connection with the submission of the respective declaration of consent. The processing operations based on your consent are therefore not listed here again (Art. 13 para. 4 DSGVO).

c. Transfer of personal data to third countries

If we transfer data to third countries, i.e. countries outside the European Union (EU) or the European Economic Area (EEA), then the transfer takes place exclusively in compliance with the legally regulated conditions of admissibility, i.e. if an adequacy decision in accordance with Art. 45 DSGVO or suitable guarantees in accordance with Art. 46 DSGVO are in place.

One of these adequacy decisions is the European Commission’s implementing decision (EU) 2016/1250 of 12.07.2016 on the so-called EU-US Privacy Shield for the USA. For transfers to companies that are certified in accordance with the EU-US data protection shield, the data protection level is generally regarded as appropriate in the sense of Art. 45 DSGVO. Furthermore, adequacy decisions exist for certain countries such as Switzerland, Canada and Israel.

Alternatively or additionally, the conclusion of the EU standard data protection clauses issued by the European Commission with the receiving body creates suitable guarantees in accordance with Art. 46 para. 2 c) DSGVO as well as an appropriate level of data protection. d. Hosting with external service providers

Our data processing is carried out to a large extent by so-called hosting service providers, who provide us with storage space and processing capacities in their computer centres and also process personal data on our behalf in accordance with our instructions. Personal data may be transferred to hosting service providers for all of the functionalities listed below. These service providers process data either exclusively in the EU/EEA or an appropriate level of data protection is guaranteed in compliance with the permissibility requirements mentioned under c..

e. Transmission to public authorities

We transfer personal data to government authorities (including law enforcement agencies) if this is necessary to fulfil a legal obligation to which we are subject (legal basis: Art. 6 Para. 1 c) DSGVO) or if it is necessary to assert, exercise or defend legal claims (legal basis: Art. 6 Para. 1 f) DSGVO).

f. Storage time

Personal data is only used by us as long as it is necessary for the respective processing purpose. After this period has expired, the data will no longer be processed by us, but will be deleted at regular intervals, unless continuous processing and storage is provided for by law (in particular because it is necessary to meet a legal obligation such as the statutory storage periods under Sections 238, 257 HGB, §147 AO or to assert, exercise or defend legal claims) or you give us a further consent.

g. Designations of data categories

In the next sections, the following summary category names in particular are used for certain types of data:

  • Account data: login/user ID and password
  • Person master data: Title, title/gender, first name, surname, date of birth
  • Address data: Street, house number, address supplements if applicable, postal code, city, country
  • Contact details: Telephone number(s), fax number(s), e-mail address(es)
  • Registration data: Information about the service you have registered for; times and technical information about registration, confirmation and cancellation; data provided by you during registration.
  • Ordering data: Ordered products, prices, payment and delivery information
  • Payment details: Account data, credit card data, data on other payment services such as PayPal / Klarna
  • Usage profile data Newsletter: Opening of the newsletter (date and time), contents, selected links, also the following information of the accessing computer system: Internet protocol address used (IP address), browser type and version, device type, operating system and similar technical information.
  • Access data: Date and time of the visit to our service; the page from which the accessing system accessed our site; pages accessed during use; session ID data; also the following information about the accessing computer system: Internet protocol address used (IP address), browser type and version, device type, operating system and similar technical information.

2. Conclusion, performance or termination of a contract

In accordance with the following description, your personal data will be processed in connection with contractual relationships between you and us. This concerns contractual relationships with customers as well as contractual relationships with suppliers and manufacturers:

3. Calling up our services

Below we describe how your personal data is processed when loading and viewing our online services, when opening and navigating within the mobile app, when using the chat function on our website and when you contact us by telephone. We would like to point out in particular that the transmission of access data to external content providers is unavoidable due to the technical functionality of information transmission on the Internet. The third-party providers themselves are responsible for the operation of the IT systems they use in compliance with data protection regulations. 10. Tracking

Below we describe how your personal data is processed using tracking technologies to analyse and optimise our services and for advertising purposes.

The description of the tracking procedures also includes information on how you can prevent or object to data processing. Please note that this so-called “opt-out”, i.e. the rejection of processing, is usually stored via cookies. If you use our services via a new terminal device or in another browser or if you have deleted the cookies set by your browser, you must declare your rejection again.

The tracking procedures presented process personal data only in pseudonymous form. A connection with a concrete, identified natural person, i.e. a combination of the data with information about the bearer of the pseudonym, does not take place.

Tracking to analyze and optimize our services and their usage

Purpose of the processing:

The analysis of user behaviour by means of tracking helps us to check the effectiveness of our services, to optimise them and to adapt them to the needs of the users as well as to correct errors. In addition, it serves to statistically determine characteristic values about the use of our services (reach, intensity of use, surfing behaviour of users) – on the basis of uniform standard procedures – and thus to obtain market-wide comparable values.

Legal basis of the processing

In the case of services provided by us in connection with a contract, tracking and the associated analysis of user behaviour are performed in order to fulfil our contractual obligations. The legal basis for this processing of personal data is Art. 6 I b) DSGVO. The evaluation of information obtained through tracking is necessary in order to provide you with optimised services in accordance with the contractual purpose and to guarantee you the greatest possible benefit.

Otherwise, i.e. outside the context of a contractual relationship, the legal basis for this processing of personal data is Art. 6 I f) DSGVO. With it, we pursue the legitimate interest of providing attractive services as efficiently as possible on the basis of the information obtained through tracking and of marketing these services in the best possible way.

The tracking procedures used in detail

Universal Analytics

How it works

Our services use Universal Analytics, a web analytics service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin, 4, Ireland (“Google”). Universal Analytics uses cookies to help the website analyze how users use the site.

Universal Analytics allows us to analyze the activities on our services across multiple devices (e.g., laptop access and later tablet access). This is made possible by the pseudonym assignment of a user ID.

The information generated by the cookie about your use of the website will generally be transmitted to and stored by Google on servers in the United States. The IP address transmitted by your browser as part of Universal Analytics is not combined with other data from Google. We have also added the code “anonymizeIP” to our Universal Analytics services. This guarantees the shortening of your IP address so that all data is collected anonymously. Only in exceptional cases is the full IP address transmitted to a Google server in the USA and shortened there.

On our behalf, Google will use this information to evaluate your use of the services, to compile reports on the activities within the scope of the services and to provide us with other services associated with the use of services and the Internet.

The data transmitted and linked to cookies or user IDs are deleted after 26 months. Data whose retention period has been reached is automatically deleted once a month.

Idealo

How it works

On our website we use tracking technology from idealo internet GmbH, Ritterstraße 11, 10969 Berlin (“idealo”) to measure the success of our advertising materials on idealo.de. When you click on one of our advertising media on idealo.de, a cookie is set on your terminal device. To do this, your browser sends an HTTP request to idealo’s server, which is used to transmit certain information. This information includes the URL of the website on which the advertising medium is placed (referrer URL), the browser identification (user agent) of the terminal device (including information on the device type and operating system), the IP address of the terminal device (this IP address is anonymised before storage), HTTP header (data packet with various technical information automatically transmitted by your browser), the time of the request and, if previously stored on the terminal device, the cookie with its entire content.

If an order is subsequently placed in our online shop, the order number (in pseudonymised form) and your shopping basket value are transmitted to idealo via the cookie. This enables idealo and we to determine how the visitors referred by idealo use our online shop for orders.

Bing Ads

How it works

Our services use Bing Ads, a web analytics service provided by Microsoft Corporation, to collect and process only technical information related to your browsing behavior in order to display personalized advertising to you.

With the goal of personalizing your online interface, the advertising presented on Microsoft Web sites and apps has been partially aligned with your interests based on your previous activities, searches, and Web site visits. The settings on this page allow you to choose whether or not to display this interest-based advertising.

Facebook Pixel

How it works

We use the so-called “Facebook Pixel” of Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA to create so-called “Custom Audiences”. This serves the purpose of optimizing our ads on the Facebook social network, playing only relevant ads there, and measuring the success of our Facebook advertising campaigns. Facebook Pixel enables Facebook to identify visitors to the XING websites as a target group for displaying ads on the Facebook social network.

Via the Facebook pixel implemented on our services, a direct connection to the Facebook servers is established when calling up our services. The Facebook server is then informed that you have accessed our services and which pages you have seen. In addition, individual information and parameters required to optimize our ads, increase relevance, and measure success are transmitted. This includes, in particular, information on so-called “conversion events” (e.g. whether a registration or a purchase has taken place).

11. Social-Media-Plugins

This website may contain plugins from social networks such as Facebook, Google+, Twitter or Pinterest. If you call up a page from our services that contains such a plugin, your browser establishes a direct connection to the servers of the respective provider. The content of the plugin is transmitted by the provider directly to your browser and integrated into the page. Through this integration, the provider receives the information that your browser has called up the corresponding page, even if you do not have a profile with this provider or are not logged in there.
